Playboy Playmate Dani Mathers could face jail time for body-shaming a woman on Snapchat, new reports have claimed.

In what could be an unprecedented ruling in regards to social networks being used to invade the privacy of others, TMZ has reported that the LAPD have worked alongside the woman featured in Dani Mathers’ Snapchat photo, with her allegedly keen to press charges against the model. The woman – reportedly in her 70s – was photographed by Mathers standing naked in a gym locker room, with Mathers including the caption “If I can’t unsee this then you can’t either” alongside the image. Mathers also took a separate photo of her laughing at the woman.

According to TheWrap, Mathers’ attorney stated that he hoped these rumors were not true, adding: “Dani Mathers never tried to hurt anyone at any time and certainly never tried to break the law.” After she attracted widespread criticism for posting the photo to her Snapchat page, Mathers later claimed that she had actually intended to send the email to her friend, but had accidentally made it available for all of her followers to view.

Mathers, who was named Playboy’s Playmate of the Year 2015, could now reportedly face up to 6 months in jail for Dissemination of Private Images. This law seeks to punish individuals guilty of “unauthorized dissemination of certain private images,” which includes “a photograph of another person in a state of nudity … in which there is no public or newsworthy purpose.” The law looks to punish those who have shared images in which the victim is identifiable and has not consented to it being displayed or published, though we could find no evidence of this law being employed in relation to images shared across social media.
